State emblem debate: HC allows judges to use Ashok Chakra

Chandigarh, December 11 Putting an end to the much debated issue of use of state emblems on official cars of the Judges of the Punjab and Haryana High Court, a division bench of the High Court held that only a triangular metal plaque depicting the Ashoka Chakra (ie Dharma Chakra that is a part of the State Emblem) can be displayed on their (Judges) vehicles.

The petition was disposed of after taking on record the recent proposed notification of the Government of India issued in August by the Ministry of Home Affairs. An affidavit to this effect was filed by the under secretary in the Ministry of Home Affairs, Arvind Mukherjee. In the affidavit it was made clear that while the State Emblem can be used only for President, Vice President, heads of foreign governments, the Chief Justice and Judges of Supreme and High Courts can use Ashok Chakra on their official vehicles.

The under secretary had submitted that the GoI is in the process of formulating the rules called as ‘State Emblem of India (Regulation of Use) Rules, 2007 which have been referred to the Ministry of Law and Justice for vetting and are likely to be notified.
